MOST COMMON LAND TITLES IN THE NIGERIAN REAL ESTATE INDUSTRY

Real estate investment in Nigeria is booming—but what truly separates smart investors from the rest is knowledge of land titles.

At Tech City Real Estate Ltd, we believe every land transaction should be backed by secure documentation. That’s why we’re shedding light on the most common land titles in Nigeria—so you can invest confidently and avoid costly mistakes.

✅ Why Land Titles Matter

Before you invest in any property, due diligence is non-negotiable. Understanding the legal status of land helps you avoid disputes, government repossession, or fraud. Below are the most recognized land titles in the Nigerian real estate space:

1. Certificate of Occupancy (C of O)

Arguably the most well-known title in Nigeria, the Certificate of Occupancy is issued by the state government and grants the right to legally occupy and use land for up to 99 years.

✅ Use for residential, commercial, or industrial purposes
✅ Land can be sold, mortgaged, or leased legally

2. Gazette

When a community’s ancestral land is officially excised by the government, it is documented in a government record known as a Gazette.

✅ Proof that the land is not under government acquisition
✅ A step towards obtaining a C of O

3. Governor’s Consent

If you’re buying land that already has a C of O or Gazette, you’ll need a Governor’s Consent. It’s a legal confirmation from the governor that ownership has legally transferred to the new buyer.

✅ Validates resale of titled land
✅ Critical for second-hand land buyers

4. Deed of Assignment

This is the legal document that transfers land ownership between two parties, often family members. It serves as a permanent record of the transaction.

✅ Must be registered at the Land Registry
✅ Includes details of transfer, land description, and boundaries

> 🔄 Similar Title: Deed of Conveyance – used when parties involved are not family members.

5. Freehold

Freehold land is not subject to government time restrictions. Owners have absolute ownership and can pass land across generations without legal interruptions.

✅ No expiration period (unlike C of O)
✅ Full rights to sell, lease, or develop the land
